Convicted sex offender, denied membership to fire dept., files complaint

A former Connecticut firefighter and convicted sex offender has filed a complaint with the state Commission on Human Rights and Opportunities– accusing the Derby Fire Dept of discriminating against him.

More specifically, Joseph Fragoso claims the Dept has denied him membership because of his “ancestry and criminal conviction.”

Fire Commissioner Michael Kelleher stands by his decision, saying, “firefighters interact with the public all the time, entering homes, schools and places of business.”

The courts noted during Fragoso’s sentencing that he “can’t have unsupervised contact with anyone under the age of 18, except for his children.”

In an article by the Hartford Courant in March 2014, it states that the former Coventry Fire Lt. was sentenced to two years in prison for sexually assaulting a 16-year-old girl. The victim in the Coventry case was reportedly a member of the department’s junior program.

During his sentencing, prosecutors told the judge Fragoso had been accused before of sexually assaulting two other girls.

Fragoso was released from prison in December 2015.  In his complaint, he wrote: “As part of my rehabilitation, I went through therapy and successfully completed treatment.”

In February, he requested to join the Derby dept again, according to the Valley Independent Sentinel. Kelleher says he’s not aware of any convicted felons who serve in the city as volunteer firefighters.

Fragoso is claiming that the fire dept has “retaliated” against him by contacting the state Fire Commissioner’s Office.

“The state is pursuing revocation of my firefighter certificates,” he wrote in the complaint, which was filed on Sept 8th.

The department has 30 days to respond.
